Terms and conditions of the Loyalty Programme

1.INTRODUCTION

1.1 Welcome to the Dibaq Diproteg, S.A. Loyalty Programme. By becoming a member, you agree to be bound by these Terms and Conditions.

1.2 Membership is free and does not require any purchase to become a member.

1.3 By becoming a member of the Loyalty Programme, you will earn points that will classify you into different levels, allowing you to take part in offers, services, events and much more organised by Dibaq. You will find more information about current gifts and offers in your private area.

1.4 You will also find information about how Dibaq will process your personal data in the Privacy Notice provided here.

1.5 Points earned online can only be redeemed online, through the dibaqpetcare.com website.

1.6 The programme is a points programme, so the accumulated balance will be converted into points and can be redeemed for discounts.

 

2.SUBSCRIPTION

2.1 Membership subscription is limited to individuals with the capacity to act on a personal basis and not as a company, who have a valid and active email account. Dibaq employees, administrators, directors, agents and representatives are entitled to subscribe, although they will be excluded from certain promotions.  

2.2 By submitting your application, you accept these Terms and Conditions.

2.3 Your subscription is personal, non-transferable and subject to these Terms and Conditions as well as any other rules, regulations, policies or procedures adopted by Dibaq and approved by you when taking part in any related offer, purchase or service. We also apply a limit of one subscription per person and account.   

2.4 Companies, groups, associations or other entities, as well as those who make wholesale or commercial purchases, are not eligible for subscription. The subscription may not be used for resale or profit-making purposes. 

2.5 You are solely responsible for keeping your email address and contact details up to date, which is an essential condition of this subscription.

 

3 LOYALTY PROGRAMME IN SPAIN   

3.1 Membership is governed by a national programme and limited to purchases made at the online shop at dibaqpetcare.com in Spain. You can only earn points when purchasing or carrying out any activity for which points are awarded in Spain, as regularly communicated to you by Dibaq.

3.2 Accumulated points are for personal use and cannot be transferred to another person or member.

3.3 Points earned on the purchase of an item will be deducted from your account if you return the item. 

3.4 As described in point 1, the loyalty programme is online only, so purchases made on the dibaqpetcare.com website will accumulate points online.

 

4 CHANGES, TERMINATION AND/OR ELIMINATION OF THE Dibaq LOYALTY PROGRAMME

4.1 You have the right to cancel your subscription at any time by deleting your account or contacting Customer Service. Please note that cancelling your subscription means that you will only be able to shop at dibaqpetcare.com if you pay as a guest.

4.2 If you cancel your account, any points you have accumulated will be lost. In addition, any credit requests will also be cancelled.

4.3 Dibaq may, at its sole discretion, terminate, alter, limit, suspend or modify the Dibaq Loyalty Programme and/or these Terms and Conditions at any time in the event of changes in applicable laws, modifications to the services provided by Dibaq or the introduction of new products or services. Any such changes shall take effect fourteen (14) business days after the date on which such change was communicated either on the website, by post/email or a combination of the above. If you do not accept the changes, you have the right to cancel your subscription.

4.4 Any proven arbitrariness towards the Dibaq Loyalty Programme, as well as proven or presumed fraud, failure to comply with the Terms and Conditions, inactivity of the subscription for more than 36 months, any misrepresentation or abnormal behaviour detrimental to the interests of Dibaq will result in the revocation of your subscription and will affect your eligibility for further participation in the Dibaq Loyalty Programme. In the event of revocation of your subscription, any points you have in the ‘My Account’ section will be automatically cancelled.

 

5 LIMITATION OF LIABILITY 

5.1 Dibaq shall not be liable for system failures or abnormal operation of the Loyalty Programme, nor for any consequences arising therefrom. Dibaq shall not be liable for any loss or damage resulting from the suspension, variation or termination or other actions related to the Loyalty Programme, except for liability that cannot be avoided by law.

 

6 APPLICABLE LAW AND JURISDICTION

6.1 These Terms and Conditions shall be governed by the laws in force in SPAIN, without regard to other rules or principles of conflict of laws. Any dispute, claim or controversy arising out of or in connection with these Terms and Conditions or the subscription shall be resolved by the competent court in SPAIN, unless otherwise agreed in mandatory consumer protection laws.
